Sale – Purchase of Property : In this transaction one must check these concerns e.g. Identification of property matching client needs¸ prevailing market rates, fixing of terms as final price, payment schedule, time of completion etc, examination of all deeds of title related to the property to be purchased, clearance of previous encumbrances and loans, ascertaining (transfer fees, stamp duty and registration charges to be paid on purchase of the property), Ascertaining outgoings to be paid for the property i.e. property tax, water and electricity charges, society charges, maintenance charges, sanctioning of pre-approval letter from the lending institution in case of loan requirement by the purchaser. One shall check Approved plan of the building, building byelaws as applicable, NOC from water, electricity and lift authorities. Broker shall form a formal agreement or document for transfer of the property, signing by both the Vendor and Purchaser for its registration, with the help of legal experts. After payment of the entire sale price, purchaser shall take over legal possession of the property along with documents of title in original from the Vendor of the property. Purchaser shall get its name registered in the records of the society, all related authorities, municipal corporation, Index II etc.
